A Federal High Court in Abuja has accepted two mobile phones as evidence in a case involving Prof. Cyril Ndifon, the suspended Dean of the Faculty of Law at the University of Calabar (UNICAL). The phones, an Oppo Phone and a Tecno Pova Phone, along with their chargers, were seized by the Independent Corrupt Practices and Other Related Offences Commission (ICPC). The ICPC’s lawyer, Osuobeni Akponimisingha, tendered the devices, and the defence counsel, Joe Agi, SAN, did not oppose their admission.

Justice James Omotosho had previously granted bail to Ndifon and Sunny Anyanwu, a lawyer charged alongside him, in the sums of N250 million and N50 million respectively, with two sureties each.

Ndifon and Anyanwu were re-arraigned on an amended four-count charge, which includes allegations of sexual harassment and attempts to pervert the course of justice. Anyanwu, a member of the defence team, faces additional charges related to allegedly threatening a prosecution witness.

During the trial, the court heard from Mr Tani Karngong, an Exhibit Keeper with ICPC, who explained his role in receiving and securing exhibits seized from suspects. Karngong confirmed receiving the two phones on October 9, 2023, along with pouches and related documents. The phones were subsequently tendered in evidence as Exhibits N and O.

Another witness, B.E. Fungo, a Forensic and Intelligence Analyst with ICPC, testified about extracting information from the phones, which included nude videos, pictures, and text messages. The extracted data was stored on a USB drive and presented as evidence.

The court adjourned to allow the ICPC to finalize its application to play video evidence in open court.
